1. How to Enter: Visit http://www.racingjunk.com (the "Site") and click on the link/graphic to “EngineQuest “Head to Vegas” Contest” and submit a completed online form in accordance with the Site's on-screen instructions between August 1, 2009 12:01 a.m. EST and October 31, 2009 11:59 p.m. EST (the "Sweepstakes Period") ("Eligible Entries") to be entered into a random drawing. One entry per person. Multiple entries will be disqualified. Entries generated by script, macro, bot, or other automated means will be disqualified. All entries become the property of Raceway Media, LLC. No purchase necessary. Not necessary to become Club RacingJunk member to enter.
2. To enter offline mail a post card to EngineQuest “Head to Vegas” Contest c/o Raceway Media, LLC, 106 Main St., North Adams, MA 01247 with your Name, Address, City, State, Zip, and email address. Mailed in entries must be received by October 31, 2009 11:59 p.m. EST. Incomplete and illegible entry forms will be deemed invalid. Not responsible for lost, misdirected, late, postage due, incomplete, illegible or unintelligible entries, lost or damaged entry or for inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical, human or other error that may occur in the processing of entries. Incomplete, mechanically reproduced, automated or photocopied entries are not permitted and will be deemed void. Limit one entry per person/email address, regardless of method of entry. Any entries submitted beyond the limits specified herein, whether via entry form, mail-in or online methods are void. Entries become property of the Sponsor and will not be returned.
3. Eligibility: Open to legal residents of the United States and the District of Columbia who are 18 years of age or older at time of entry. If a Winner cannot furnish verifiable and valid proof of age within three (3) business days after being notified of winning, an alternate Winner may be chosen from among all remaining Eligible Entries received at Raceway Media, LLC sole discretion. Employees of Raceway Media, LLC and/or EngineQuest, and their respective parent companies, subsidiaries, divisions, affiliated companies, advertising and promotion agencies, and their immediate families (defined as spouse, parents, siblings, and children) and those with whom such persons reside are not eligible to enter or win.
4. Prizes: All winners will be picked randomly at the conclusion of the contest, from all Eligible Entries. One Grand Prize Winner will receive a trip for two to the 2009 Duel in the Desert at Las Vegas Motor Speedway November 12- 15, 2009 (valued at $1,500.00). Trip includes two roundtrip tickets (not to exceed $500.00 per person), hotel accommodations for three nights (not to exceed $125.00 per night), ground transportation to/from airport in Las Vegas (not to exceed $60.00), and tickets to the race. All meals, taxes, tips and other fees not specifically mentioned are the sole responsibility of the winner. Trip will be confirmed between contest winner and EngineQuest after IRS 1099 form is filled out for the approximate retail value of the trip. No transfer, substitution, or cash equivalent for the prize permitted, except by Raceway Media, LLC, in its sole discretion. One First Prize winner will be selected to win a set of two EngineQuest Cylinder Heads ($700.00 value). Ten Second Place Prize winners will win IMCA prize kits ($55.00 value) and ten Third Place Prize winners will receive EngineQuest prize kits ($40.00 value).
5. Drawing and Notification: All winners, including the Grand Prize winner, will be selected randomly from all Eligible Entries and notified, on or about November 2, 2009. EngineQuest will attempt to contact the potential winners by phone and email. (EngineQuest will make up to three (3) attempts over a 24-hour period to contact the potential winners by telephone.) If EngineQuest or its designee is unable to contact a potential winner by phone (using the contact information provided at the time of entry) and/or if a potential winner fails to respond to notification within three (3) business days of EngineQuest’s attempted contact, such winner will be disqualified and forfeit his or her right to a prize, and an alternate winner will be selected from the remaining eligible entries.
6. Limitations of Liability: Raceway Media, LLC, EngineQuest, and their respective parent companies, subsidiaries, divisions, affiliated companies, advertising and promotion agencies, and the officers, directors, shareholders, employees, and agents of each (collectively "Released Parties") disclaim any responsibility for mechanical, transportation, casualty losses, technical, electronic, communications, telephone, computer, hardware or software malfunctions or failures of any kind, including but not limited to: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any web site or lost or unavailable network connections which may limit an entrant's ability to participate in the Sweepstakes, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. Raceway Media, LLC reserves the right to cancel, terminate, and alter sweepstakes duration, and modify or suspend the Sweepstakes without notice. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE RACEWAY MEDIA, LLC's WEB SITE OR ENGINEQUEST WEB SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RACEWAY MEDIA, LLC AND ENGINEQUEST RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE MASSACHUSETTS COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF MASSACHUSETTS SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. By their entry, Entrants hereby release, discharge, indemnify and hold harmless the Released Parties from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes.
7. Non-Endorsement: The use of any non-Raceway Media, LLC's trademarks, service marks, names, likeness and/or voice (collectively, "Property") in connection with this Sweepstakes or award of any prize is not meant by Raceway Media, LLC to imply the paid-endorsement by Raceway Media, LLC of the respective owner(s) of such Property, or any affiliation of the respective owner(s) of such Property with the Sweepstakes.
8. Winner List: The name of the Grand Prize winner, one first place winner, 10 second place winners and 10 third place winners will all appear in the RacingJunk.com Member Newsletter after they have been notified. A list of winners may also be obtained by mailing a stamped, self addressed envelope by December 31, 2009 to “EngineQuest Winners List Request c/o Raceway Media, LLC, 106 Main St., North Adams, MA 01247.
